License Agreement for Abacre e-Commerce of Abacre Limited You should carefully read the following terms and conditions before using this service. Your use of this service indicates your acceptance of this license agreement and warranty. Definitions ---------------------------------------------------------------------- "Service" means Abacre e-Commerce service provided by Abacre Limited via Abacre's site. "Vendor" means physical person or company using the service. "Client" means a customer to whom vendor sells his products and services. "Items" means products and services are sold by vendor to client. "Abacre's site" means web sites: www.abacre.com and www.abacre.net and all their subdomains. "Abacre" means Abacre Limited, a Russian company, having registered office: Savushkina d 9, lit A, pom 5N, 197183 St. Petersburg, Russian Federation. "Abacre e-commerce provider" means a business person chosen by Abacre to sell to vendor paid account subscriptions. Governing Law ---------------------------------------------------------------------- This agreement shall be governed by the laws of Russian Federation and corresponding international laws. Disclaimer of Warranty ---------------------------------------------------------------------- THIS SERVICE IS OFFERED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. The vendor must assume the entire risk of service. ANY LIABILITY OF ABACRE WILL BE LIMITED EXCLUSIVELY REFUND OF PURCHASE PRICE. Period of use --------------------------------------------------------------------- Vendor starts using this service as soon as she press Sign Up button on vendor's sign up page. Abacre will try offer the service as long as vendor satisfied the license agreement. The license agreement may be terminated by vendor any time by sending request to Abacre. After termination of the agreement Abacre has right to keep or remove vendor's database containing information about vendor items, orders, clients etc. Responsibilities ---------------------------------------------------------------------- Vendor is responsible to keeping his shops from spam content and not selling forbidden products and services. Vendor is using the service to sell his product to clients. Abacre is not acting as seller for client. Therefore Abacre is not responsible for delivery of any products and services sold by vendor to client. Vendor is responsible for all her selling activities. Vendor cannot create duplicate items. Vendor can open several accounts using Abacre's service, but vendor cannot open duplicate accounts (account with the same or very similar items). Abacre has a right to suspend or completely remove vendor's account with or without notice in case of violation of the license agreement. Abacre is not responsible to giving direct database access to vendor to vendor's data. Forbidden items ---------------------------------------------------------------------- * All adult content, products and services * All pharmacy products * All copyrighted content belonged to other parties * Weapons and all other products and services forbidden by international laws. Types of accounts ---------------------------------------------------------------------- The service is offered under two types of accounts: * Free account. The service is offered via 4th level domain names of Abacre's site. * Paid account. The service is offered as a paid subscription with price $29.99 USD per month. Vendor may stop using the paid account any time by sending request to Abacre's e-commerce provider. The remained number of days after termination of the service is not refunded. Support ---------------------------------------------------------------------- Vendor should contact support@abacre.com for support. Abacre does not offer free or paid phone support.
